The First Amendment to the United States Constitution protects freedom of speech, freedom of the press, freedom of religion, the right to peacefully assemble, and the right to petition the government. These constitutional protections form the foundation of communication law in the United States and remain highly relevant in today’s digital environment.
Although digital communication technologies did not exist when the Constitution was written, the principles established by the First Amendment continue to apply to modern forms of communication such as websites, blogs, podcasts, streaming platforms, online news organizations, and social media.
Understanding the balance between constitutional protections and legal limitations helps organizations communicate confidently while reducing unnecessary legal risk.
